Court of Appeal delivers key judgment in constitutional appeal by Sindu Parekh
The Court of Appeal on Tuesday delivered its judgment in the case of Parekh v Attorney General, drawing strong observations from the bench on abuse of court process and the responsibilities of legal counsel.
The appeal was against a decision of the Constitutional Court, which had upheld a preliminary objection that the appellant had filed his petition in the wrong forum. Instead of applying to the Court of Appeal to review its own decision, the appellant had gone before the Constitutional Court, challenging a judgment of the country’s highest court.
