Court invalidates 10th Constitutional Amendment
The Constitutional Court of Seychelles has declared the 10th Amendment of the Constitution “unconstitutional”.
The case originated from a petition filed in September 2022 by the Seychelles Human Rights Commission, the Ombudsman, and the Bar Association of Seychelles. The petition challenged the amendment following its approval by the National Assembly on May 31, 2022, and subsequent assent by former President Wavel Ramkalawan on June 14, 2022.
The amendment modified provisions concerning the Seychelles Defence Forces (SDF), granting them authority to enforce domestic laws related to public security, environmental protection, and maritime security. Specifically, the amended Article 163 was intended to permit military personnel to assist police forces in non‑emergency situations.
