ANB 2019 Communiqué - Man gets suspended conviction over drugs charges

Franklin Radegonde, a 29-year-old unemployed male Seychellois of La Passe, La Digue, was on Monday sentenced to 1 year imprisonment, suspended for 2 years and a fine of R10,000 to be paid within 6 months starting on the sentenced date.

Appearing before Judge Gustave Dodin in the Supreme Court, Radegonde pleaded not guilty to the charge of trafficking in of a controlled drug but pleaded guilty to alternative charges of possession of a controlled drug (9.11g of heroin) plus 0.45g of hashish, and escape from lawful custody after he was arrested by officers of the Anti-Narcotics Bureau (ANB) of the Seychelles Police Force in May 2019 at La Passe, La Digue.

In a mitigation plea, Radegonde’s lawyer noted that her client has not wasted the court’s time, is a father of two minors, is still young, has completed his treatment successfully and is clean from his addiction.

The lawyer also noted that her client s a second chance as he regrets what he has done.

Judge Dodin took consideration of the lawyer’s arguments and sentenced Radegonde to 1 year imprisonment, suspended for 2 years, and a fine of R10,000 to be paid within 6 months starting on the sentenced date. Failure to pay the sum Radegonde will do his 1-year prison term for the first charge, and for the second and third charges he was given 1-year imprisonment for each but suspended for 2 years. All three sentences will run concurrently, and he should not commit any similar offences during the two years suspension, or he will spend one year in prison.
