Mozambican woman and Seychellois man sentenced for drug related offences |21 November 2019

A Mozambican saleswoman, Julia Nilzo Tembe and a self-employed Seychellois man, Tony Palmyre, have been sentenced in relation to various drug charges against them.

The Supreme Court on Tuesday November 19, 2019 sentenced Tembe to five years imprisonment (time she has spent on remand shall be counted towards her sentence) for an amended charge of trafficking by means of transportation of 5.31kg of compressed cannabis which she was found in possession of on April 18, 2019 upon her arrival at the Seychelles International Airport.

On the same day of her arrival, Tembe was arrested by officers of the Anti-Narcotics Bureau (ANB) of the Seychelles Police Force with the help of immigration and customs officers. She was travelling with the drugs from Johannesburg, South Africa on board an Air Seychelles flight to Seychelles.

In another conviction case before the Supreme Court on Monday November 18, 2019, Palmyre was convicted for multiple counts of unlawful possession of a controlled drug and permitting or offering his residence at Cascade to be used for the purpose of trafficking in a controlled drug.

His sentences are as follows:

  • For the unlawful possession of a controlled drug namely of 11.74 grammes of herbal cannabis and 3.85 grammes of cannabis resin, separately for both possessions, he has been fined R3,000 to be paid before the end of November 2019. In default of payment of both the fines of R3,000, he is to serve a term of one month imprisonment.

·          For permitting or offering his residence to be used for the purpose of trafficking in the following amount and types of drugs :

  1. For 114.18 grammes of heroin (25.21 grammes of pure heroin content), he is sentenced to a term of one-year imprisonment which is suspended for a period of two years and additionally a fine of R10,000 to be paid before the end of January 2020. In default of payment of the fine of R10,000, Palmyre is to serve a term of 6 months imprisonment.
  2. For 78.75 grammes of herbal cannabis, he is sentenced to a term of six months imprisonment which is suspended for a period of two years and a fine of R5,000 to be paid before the end of February 2020. In default of payment of the fine of R5,000, he is to serve a term of 3 months imprisonment.
  3. For 79.88 grammes of cannabis resin, he is sentenced to a term of six months imprisonment which is suspended for a period of two years, and a fine of R5,000 to be paid before the end of March 2020. In default of payment of the fine of R5,000, the convict is to serve a term of 3 months imprisonment.

The terms of imprisonment imposed on Palmyre for permitting or offering his residence to be used for the purpose of trafficking in a controlled drug are to run concurrently and the time he has spent in remand will be deducted from his sentence.

Palmyre committed all these offences at his residence on August 20, 2019 when he was arrested by ANB officers.

He pleaded guilty to all of the charges against him.
